1. ACCEPTANCE

By using and/or visiting the Doc Sniper website (collectively, including but not limited to: all Content, Uploads and User Submissions available through DocSniper.com, "Doc Sniper", the website) you agree to the terms and conditions contained herein and to the terms and conditions of Doc Sniper Pty Ltd’s privacy policy incorporated herein, and all future amendments and modifications (collectively referred to as the "Agreement"). By entering, you agree to be bound by these terms and conditions. If you do not agree to be bound by the terms and conditions contained herein, then you cannot use the services offered by DocSniper.com.

The terms and conditions of this Agreement are subject to change by Doc Sniper Pty Ltd at any time in Doc Sniper Pty Ltd’s sole discretion and you agree be bound by all modifications, changes and/or revisions to the terms of Agreement. If you do not accept to be bound by any and all modifications, changes and/or revisions of this agreement, you cannot use the services offered by Doc Sniper.com.

The terms and conditions contained herein apply to all users of Doc Sniper Pty Ltd’s website whether a 'visitor' or a 'member' and you are only authorized to use Doc Sniper.com if you agree to abide by all applicable laws and be legally bound by the terms and conditions of this Agreement.

2. DESCRIPTION

The Doc Sniper website allows for uploading, sharing and general viewing of various types of content. The Doc Sniper website allows both registered and unregistered users to share and view visual content. In addition, DocSniper.com contains video content, information and other materials posted/uploaded by users. Doc Sniper Pty Ltd allows its users to view the Content and Website subject to cooperation with the terms and conditions of this Agreement.

The Doc Sniper website may also contain certain links to third party websites which are in no way owned or controlled by Doc Sniper. Doc Sniper assumes no responsibility for the content, privacy policies and practices of any and all third party websites. Doc Sniper Pty Ltd cannot censor or edit the content of third party sites. You acknowledge that Doc Sniper will not be liable for any and all liability arising for your use of any third-party website.

DocSniper.com is for your personal use and shall not be used for any commercial endeavor except those specifically endorsed or approved by DocSniper.com. Any illegal and/or unauthorized use of Doc Sniper is prohibited including but not limited to collecting usernames and e-mail addresses for sending unsolicited emails. Unauthorized framing or linking to the Doc Sniper website is prohibited.

3. ACCESS

In order to use this website, you affirm that you are at least thirteen (13) years of age. If you are under the age of 13, then you are not permitted to use DocSniper.com

A user over the age of thirteen (13) is authorized to upload videos and use website, vote, post in forums however in order to enter a competition a user must be at least 18 years of age upon submission of entry or if under 18, the use must have the express written permission of the user’s legal parent or guardian emailed to minor@DocSniper.com

4. CONDUCT

You acknowledge and agree that you shall be responsible for your own user submissions and the consequences of posting, uploading, publishing, transmitting or otherwise making your submissions available on DocSniper.com. You agree that you shall not (nor allow any others to do so while using your account) post, upload, publish, transmit or make available content which is in any way illegal, unlawful, harassing, harmful, threatening, tortuous, abusive, defamatory, obscene, libelous, invasive of one's privacy on DocSniper.com, including but not limited to: personal information as well as hateful and racial information. You also agree that you shall not post, upload, publish, transmit or make available in any way on Doc Sniper software containing viruses or any other computer code, files, or programs designed to destroy, interrupt, limit the functionality of, monitor, or persistently reside in or on any computer software or hardware or telecommunications equipment.

You agree that you shall not (nor allow any others to do so while using your account to) post, upload, publish, transmit or make available in any way on Doc Sniper content which is intentionally or unintentionally violating any applicable local, state, national, or international law, or any regulations or laws coming under the force of law where you reside and elsewhere, including but not limited to: any laws or regulations relating to securities, privacy, and export control regarding engaging in or promoting. You agree that you shall not (nor others using your account) post, upload, publish, transmit or make available in any way on DocSniper.com content which depicts illegal activities, promotes or depicts physical harm or injury against any group or individual, or promotes or depicts any act of cruelty to animals.

You agree not to use DocSniper.com in any way that exposes Doc Sniper Pty Ltd to criminal or civil liability.

You agree that Doc Sniper Pty Ltd shall have the right to determine in its sole and unfettered discretion, what action shall be taken in the event of any discovered or reported violation of the terms and conditions contained herein.

5. INTELLECTUAL PROPERTY

The Content contained on the Doc Sniper website (with the exception of User Submissions) including but not limited to the text, software, scripts, graphics, music, videos, photos, sounds, interactive features and trademarks, service marks and logos contained therein, are owned by and/or licensed to Doc Sniper Pty Ltd, subject to copyright and other intellectual property rights under Australian and foreign laws and international conventions. Content on the Website is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Doc Sniper Pty Ltd reserves all rights not expressly granted to the Website and the Content.

You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein; including any use, copying, and/or distribution of User Submissions of third parties obtained through the Website for any commercial purposes. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to disable, circumvent, or otherwise interfere with security related features of the Doc Sniper website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Doc Sniper Website or the Content therein.

6. USER SUBMISSIONS 

Doc Sniper permits the submission of video and other communications and the hosting, sharing and publishing of such user submissions. You understand that whether or not such User Submissions are published and/or uploaded, Doc Sniper Pty Ltd does not guarantee any confidentiality with respect to any submissions.

Doc Sniper Pty Ltd allows/permits you to link to materials on the Doc Sniper Website for personal, non-commercial purposes only. Moreover, Doc Sniper Pty Ltd provides an "Embeddable Player" feature, which you may incorporate into your own personal, non-commercial websites for use in accessing the materials on the Doc Sniper website, provided that you include a prominent link back to the Doc Sniper website on the pages containing the Embeddable Player. Doc Sniper Pty Ltd reserves the right to discontinue any aspect of the Doc Sniper website at any time. In addition, you may not modify, build upon or block any portion of the Embeddable Player in any way. 

You must certify that you are at least 18 years of age at the time of submitting any uploaded material into a Doc Sniper Pty Ltd funded competition advertised on DocSniper.com where there is a cash or online credit prize attached to the winning entry and/or runner up. If you are not at least 18 years of age at the time of submission of an entry into a Doc Sniper Pty Ltd run competition you will not be able to claim any prizes won by entering the competition and will forfeit your right to the prize pool. 

You shall be solely responsible for any and all of your own User Submissions and the consequences of posting, uploading and publishing these submissions. Furthermore, where User Submissions are concerned, you affirm, represent and/or warrant that: you own or retain the necessary licenses, rights, consents, and permissions to use and authorize Doc Sniper Pty Ltd to use all trademarks, copyrights, trade secrets, patents, or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service and that you have the written consent, release, and/or permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service. For clarity, you retain all of your ownership rights in your User Submissions. By submitting the User Submissions to DocSniper.com you hereby grant Doc Sniper Pty Ltd a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Doc Sniper Website and Doc Sniper Pty Ltd’s (and its successor's) business, including without limitation for promoting and redistributing part or all of the Doc Sniper Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Doc Sniper Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. The foregoing license granted by you terminates once you remove or delete a User Submission from the Doc Sniper Website.

In submitting material (video or other communication), you further agree that you shall not:

- submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Doc Sniper Pty Ltd all of the license rights granted herein;

- publish falsehoods or misrepresentations that could cause damage to Doc Sniper Pty Ltd or to any third party;

- submit material that is obscene, illegal, unlawful, defamatory, libelous, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate;

- post advertisements or solicitations of business;

- Impersonate another person (unless prior written consent is given by the person impersonated).

Doc Sniper Pty Ltd does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Doc Sniper Pty Ltd expressly disclaims any and all liability in connection with User Submissions. Doc Sniper Pty Ltd does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and Doc Sniper Pty Ltd will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. Doc Sniper Pty Ltd reserves the right to remove Content and User Submissions without prior notice or delay. Doc Sniper Pty Ltd will also terminate a User's access to its Website, if they are determined to be an infringer. Doc Sniper Pty Ltd also reserves the right to decide in its sole and unfettered discretion, whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to: obscene or defamatory material, or excessive length. Doc Sniper Pty Ltd may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

You understand and acknowledge that when using Doc Sniper.com, you will be exposed to User Submissions from a variety of sources, and that Doc Sniper Pty Ltd is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Doc Sniper Pty Ltd with respect thereto, and agree to indemnify and hold Doc Sniper Pty Ltd, its Owners, affiliates, operators, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the website.

You agree that Doc Sniper Pty Ltd may at its sole discretion have the right to refuse to publish, remove, or block access to any User Submission that is available via the Website or other Doc Sniper Pty Ltd’s network or services at any time, for any reason, or for no reason at all, with or without notice.

Doc Sniper Pty Ltd provides its website as a service to its users. However, Doc Sniper Pty Ltd assumes no responsibility whatsoever for monitoring the Doc Sniper Services for inappropriate content or conduct. However if at any time Doc Sniper chooses, in its sole discretion, to monitor the Doc Sniper Services, Doc Sniper Pty Ltd assumes no responsibility for the content, no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the User submitting any such content. Doc Sniper Pty Ltd may review and delete any User Submissions that, in its sole judgment, violates this Agreement or may be otherwise offensive or illegal, or violate the rights, harm, or threaten the safety of any User or person not associated with the Website (collectively "Inappropriate User Submissions"). You are solely responsible for the User Submissions that you make visible on the Website or to any third-party website via an embedded player provided by the Website or any other material or information that you transmit or share with other Users or unrelated third-parties via the Website.

7. POLICY

Doc Sniper Pty Ltd abides by a ZERO TOLERANCE policy relating to the upload or posting of any illegal content. Child Pornography, bestiality, rape, torture, snuff, death and/or any other type of obscene and/or illegal material shall not be tolerated by Doc Sniper Pty Ltd. Doc Sniper Pty Ltd shall not condone child pornography and will cooperate with all governmental agencies that seek those who produce child pornography.

8. FEES

By using the services offered by DocSniper.com, you acknowledge that Doc Sniper Pty Ltd reserves the right to charge for Doc Sniper Pty Ltd’s services and to change its fees from time to time in its discretion. Furthermore, in the event Doc Sniper Pty Ltd terminates your rights to use the website because of a breach of this Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.

9. WARRANTIES

You represent and warrant that all of the information provided by you to Doc Sniper Pty Ltd in order to participate in the DocSniper.com website is accurate and current and you have all necessary right, power, and authority to enter into this Agreement and to perform the acts required of you hereunder.

As a condition to using DocSniper.com, you must agree to the terms of Doc Sniper Pty Ltd’s privacy policy and its modifications. You acknowledge and agree that the technical processing and transmission of the Website, including your User Submissions, may involve transmissions over various networks; and changes to conform and adapt to technical requirements of connecting networks or devices. You further acknowledge and agree that other data collected and maintained by Doc Sniper Pty Ltd with regard to its users may be disclosed in accordance with the Doc Sniper Pty Ltd’s Privacy Policy.

10. WARRANTY DISCLAIMER

You agree that your use of the DocSniper.com website shall be at your sole risk. To the fullest extent permitted by law, Doc Sniper Pty Ltd, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the website and your use thereof. Doc Sniper Pty Ltd makes no warranties or representations about the accuracy or completeness of this site's content or the content of any sites linked to this site and assumes no liability or responsibility for any errors, mistakes, or inaccuracies of content, personal injury or property damage, of any nature whatsoever within the content, resulting from your access to and use of our website; any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, any interruption or cessation of transmission to or from our website; any bugs, viruses, trojan horses, or the like which may be transmitted to or through our website by any third party, and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the DocSniper.com website. Doc Sniper Pty Ltd does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the DocSniper.com website or any hyperlinked website or featured in any banner or other advertising and Doc Sniper Pty Ltd will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services.

As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. By agreeing to use DocSniper.com, you specifically acknowledge that Doc Sniper Pty Ltd shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that you agree to be responsible for any risk of harm or damage which occurs to you as a result of viewing any content.

11. LIMITATION OF LIABILITY

In no event shall Doc Sniper Pty Ltd, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any errors, mistakes, or inaccuracies of content, personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website, any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, any interruption or cessation of transmission to or from our website, any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our website by any third party, and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the DocSniper.com website, whether based on warranty, contract, tort, or any other legal theory, no matter whether or not the company is advised of the possibility of such damages occurring. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. By agreeing to use the website, you specifically acknowledge that Doc Sniper Pty Ltd shall not be liable for any damaging content within user submissions or the defamatory, offensive, or illegal conduct of any third party and that you agree to be responsible for any risk of harm or damage which occurs to you as a result of viewing any content.

12. INDEMNITY

You agree to defend, indemnify and hold harmless Doc Sniper Pty Ltd, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

your use of and access to the Doc Sniper Website at www.DocSniper.com;

your violation of any term of these Terms of Service;

your violation of any third party right, including without limitation any copyright, property, or privacy right; or

any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Doc Sniper Pty Ltd Website.

You affirm that you are either more than 18 years of age or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms and Conditions contained herein.

13. ASSIGNMENT

The Terms and Conditions contained herein and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Doc Sniper Pty Ltd without restriction.

If any term, clause or provision of the agreement is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any term, clause or provision and such invalid term, clause or provision shall be deemed to be severed from this Agreement within that particular jurisdiction instead.

14. JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles. The sole and exclusive jurisdiction and venue for any action or proceeding arising out of or related to this Agreement shall be in an appropriate state or federal court located in Queensland, Australia. By agreeing to use the services offered by DocSniper.com, you hereby submit to the jurisdiction and venue of said Courts. You consent to service of process in any legal proceeding which may arise as a result of breaching Doc Sniper Pty Ltd’s Terms of Use.

SPECIFIC CONTEST TERMS AND CONDITIONS

15. Technical Requirements: The maximum file size for any video file uploaded to DocSniper.com is 100 MB. Video file(s) submitted to your DocSniper.com account must be provided in one of the following file formats: .avi, .mov, .mpg, or .wmv.

16. Additional Requirements: Once you complete and submit your video, your Submission is final and may not be modified or edited. No Submissions will be returned or refunded. The person named as the registered owner of the user account on Doc Sniper associated with the Submission for the Submission must match and that person will be deemed the entrant ("Entrant"). In the event of a dispute regarding the identity of an Entrant, the dispute will be resolved in favor of the individual who is the "authorized e-mail account holder" of the e-mail address provided when the Doc Sniper user account was created. "Authorized email account holder" is defined as the natural person assigned an e-mail address by an Internet access provider, online service provider, or other organization (i.e., business, education institution) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If any group of individuals elects to collaborate on a Submission, they are required to designate one (1) representative to enter the Contest and accept the prize on behalf of the group. Doc Sniper Pty Ltd is not liable for any disputes between collaborators related to a Submission. Your video may contain more than one person and include costumes, props and/or musical instruments, provided all other rules and terms related to the contest you are entering are complied with. We are looking for videos that demonstrate creativity, enthusiasm and uniqueness. Videos that contain inappropriate content, including but not limited to vulgarity, obscenity, lewd, pornographic or violent material, or materials which promote violence or which disparage Doc Sniper or any other person or entity, will be disqualified at Doc Sniper Pty Ltd’s sole discretion. Use of any elements other than the cleared elements, including but without limitation to: speech/voiceovers, video, stills, visuals or other materials that are not original, contained in the public domain, or downloaded from the Web Site may result in disqualification of Submission, in Doc Sniper Pty Ltd’s sole discretion. Entries that contain any footage from the example videos posted by Doc Sniper on the Web Site will be disqualified. Entries that do not comply with the video specifications or any other requirements stated herein will not be accepted and/or will result in disqualification of Submission, as per Doc Sniper Pty Ltd’s discretion. Entrants are subject to all notices posted online including but not limited to: privacy policy. All entries and requests become Doc Sniper Pty Ltd’s property and will not be returned or the receipt of them acknowledged. Doc Sniper Pty Ltd is not responsible for lost, late, damaged, or misdirected entries.

17. Conditions of Entry: As a condition of entry into these Contests, an entrant must be at least 18 years of age and/or of legally constituted adult age within the entrant’s jurisdiction at the time of the submission of entry. If an entrant is a minor then the minor must have the written permission of their parent or legal guardian in the form of an Affidavit/Release/Agreement which must be signed by the parent or legal guardian on minor's behalf. To be considered for eligibility while being a minor, please forward the forms to minor@DocSniper.com.

By uploading and entering a Submission, the Entrant warrants and represents that the Submission (a) is original and has been legally created and (b) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party. Entrant represents that he/she owns all rights to his/her Submission, including but without limitation to: the copyright in the performance contained therein and the original music and lyrics. Entrant further represents and warrants that the Entrant has obtained permission from each person whose name, image, likeness or voice ("Likeness") is included in the Submission, and that such person(s) have granted Entrant all necessary rights to use the person's Likeness as described in these rules, and that Entrant can make written copies of such permissions available to Doc Sniper Pty Ltd upon request. If the Likeness of a minor is included, such grant of rights must include written permission from the minor's parent or legal guardian authorizing the use of the minor's Likeness on behalf of the minor. By uploading a Submission, the Entrant irrevocably grants Doc Sniper Pty Ltd and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, edit, store, record, distribute, merchandise, adapt and/or modify, copy, transmit, publish, post, broadcast, display, publicly perform, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times the material is reused), the Entrant's Submission, including, but not limited to: the recording and the performances contained therein (in each case, as submitted or as edited/modified in any way by Doc Sniper Pty Ltd in its sole discretion), as well as to use Entrant's name, Likeness, photograph and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude Doc Sniper Pty Ltd’s use of the Submission, and agrees not to sue or assert any claim against the Doc Sniper Pty Ltd for the use of the Submission or Entrant's Likeness or statements. Entrant agrees to indemnify and hold Doc Sniper Pty Ltd, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnities due to or arising out of the Entrant's Submission, or the Entrant's conduct in creating a Submission or otherwise in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement; violation of an individual's right of publicity or right of privacy; or defamation. Entrant further agrees to release Doc Sniper Pty Ltd from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of Doc Sniper Pty Ltd infringes Entrant's rights with regard to any elements, characters or ideas contained in any Submission. Any posting of submission does not deem your entry a winner or correlate to the score given to your Submission in the Contest. You agree to abide by these official rules and the judge's decisions, which are final and binding in all respects.

What does this scary looking section mean?

It simply means that we are allowed to store and display your video. You retain all copyright to your own work!

18. Purchasing shots. All shots and packages are priced in US DOLLARS only.

19. Membership: is FREE except subscribers (see point 19 (a) for details)

20. All merchandize and products. All merchandize and products are priced in US DOLLARS only.

21. Judging: The members of DocSniper.com will vote for their favorite video. The Videos will be ranked in order from the video with the greatest number of votes to the one with the fewest number of votes. The video with the greatest number of votes will be declared by Doc Sniper as the Prize Winner for the month and will be awarded jackpot prize pool for that contest (subject to verification).

22. Tie breaker: In the event of a tie for either a monthly contest and or the REEL AWARDS: Doc Sniper will make the final decision based upon the following judging criteria:

  1. 40% of the judgment’s result will be determined based upon the creative expression present within the video.
  2. 20% of the judgment’s result will be determined based upon the originality and uniqueness of the video.
  3. 40% of the judgment’s result will be determined based on the submission’s level of enthusiasm: Doc Sniper Pty Ltd’s decisions are final and binding in all respects and no correspondence will be entered into.

23. Winner Notification: Winners will be notified via an email to the registered owner of the user account at DocSniper.com and/or via telephone at the judges' and/or Doc Sniper Pty Ltd’s discretion.

  • At the 7th day after the competition has been won, if the winner cannot be contacted or doesn’t respond within seven (7) days of the first notification then the judges and/or Doc Sniper Pty Ltd at their discretion will try to contact the winner or registered owner of the user account again by telephone and by additionally posting a message on the website address of DocSniper.com announcing of the entrant’s Submission as the monthly successful candidate of the competition and of the fact that they have been unable to reach the entrant to give the entrant the ability of claiming the allocated prize.
  • On the14th day the competition has been won, if the winner cannot be contacted or doesn’t respond within fourteen (14) days of the first notification then the judges and/or Doc Sniper Pty Ltd at their discretion will try again to contact the winner or registered owner of the user account again by telephone and by additionally posting a message on the website DocSniper.com announcing the entrant’s Submission as the monthly successful candidate of the competition and of the fact that they have been unable to reach the entrant to give the entrant the ability of claiming the allocated prize.
  • On the 21st day after the competition has been won, If the winner cannot be contacted or doesn’t respond within twenty one (21) days of the first notification then the judges and/or Doc Sniper Pty Ltd at their discretion will try again to contact the winner or registered owner of the user account by telephone and by additionally posting a message on the website DocSniper.com announcing the entrant’s Submission as the winner of the competition and of the fact that they have been unable to be reach the winning entrant, ONE LAST TIME. If still no response is received, the allocated prize will be held in trust for a further 60 days. At the conclusion of the additional 60 days after the first 21 days after the first notification or the entrant as the monthly successful candidate of the competition, the winnings will be forfeited and received by the second place holder. All decisions are final and binding in all respects and no correspondence will be entered into after the prize pool has been allocated to the winning entrants.

24. Contract/Prizes and Approximate Retail Values for the monthly successful candidate: The contract is an agreement between Doc Sniper Pty Ltd and the monthly successful candidate and stipulates that the monthly successful candidate agrees to allow Doc Sniper Pty Ltd (except where prohibited by law) to use the monthly successful candidate's name, amount of funds awarded for the right to broadcast the successful entry, hometown, likeness, photograph, voice, address (city and state) and biographical information for the purposes of advertising, online posting, promotion and publicity without additional compensation. The successful monthly candidate allows Doc Sniper Pty Ltd to use the successful video footage in return for the remuneration contracted for in the contract signed by the monthly successful candidate upon official notification of the entry’s success as per the methods stated in subsection 23. Doc Sniper reserves the right to change the prize pool at any given time without notice at Doc Sniper's own discretion. The successful monthly candidate also allows Doc Sniper Pty Ltd to use any footage/material the successful candidate agrees to participate in if asked to by Doc Sniper by Pty Ltd for broadcast online and/or in regional/national/international media should the opportunity arise without any additional compensation. Contract/Prizes will be awarded if there are sufficient numbers of entries received to cover operational costs and/or expenses of the competition. If this condition is met in the competition entered into by the monthly successful candidate, then the monthly-awarded contract will be granted to the candidate plus any additional funds at Doc Sniper Pty Ltd’s discretion.

26. Releases: by participating in this contest, you (and, if you are a minor, your parent or legal guardian) accept all risk and consequences of entry and participation in this contest and agree to release and hold harmless Doc Sniper Pty Ltd and all entities involved in the contest/s and their respective officers, directors, shareholders, employees, representatives, agents, successors and assigns from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this contest, including but not limited to: your entry and participation in the contest/s, the acceptance and/or use (or misuse) of any prizes, printing errors and any claims based upon the rights of publicity and invasion of privacy, even if one or more of the promotion parties or any of the other released parties were aware of the possibility of any such consequences, losses, damages, etc. You (and, if you are a minor, your parent or legal guardian) acknowledge that all prizes and contracts are awarded as-is: Doc Sniper Pty Ltd is not in any manner responsible or liable for any representation, guarantee or warranty, expressed or implied, in law or in fact, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Without limiting the foregoing, you (and, if you are a minor, your parent or legal guardian) further agree that neither Doc Sniper Pty Ltd nor its affiliates, prize suppliers, and their respective officers, directors, shareholders, employees, representatives, agents, successors and assigns, shall be liable for any damages, losses, costs or expenses of any kind, arising from or related to circumstances beyond the reasonable control of sponsor, promotional parties or their affiliates, prize suppliers, and their respective representatives and agents, including but not limited to: acts of God, acts of government, acts of terror, acts of war, civil unrest, labor shortages and/or strikes, even if any one or more of the promotion parties or any of the other released parties were aware of the possibility of any such events occurring.

27. Miscellaneous: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void and cannot be used within any Competitions. Doc Sniper Pty Ltd is not responsible for: (i) lost, late, misdirected, damaged, or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Doc Sniper Pty Ltd on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to Entrant's or any other person's computer related to or resulting from participating in the Contest. By participating in the Contest, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Doc Sniper Pty Ltd and the independent judging organization, which are final and binding in all matters relating to the Contest. Failure to comply with these official rules may result in disqualification from the Contest. Doc Sniper Pty Ltd reserves the right to: (i) permanently disqualify from any Contest run by Doc Sniper Pty Ltd any person believed to have intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted (including any situation wherein a computer virus or system malfunction inalterably impairs its ability to conduct the Contest), and to determine winners from among all eligible entries received prior to withdrawal.

28. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT THE INDIVIDUAL IS AN ENTRANT TO A COMPETITION OR WHETHER OR NOT THE ENTRANT IS A REGISTERED USER, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE CONTEST/S, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND DOC SNIPER PTY LTD RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
